EXPLANATORY NOTE

The Bill amends the Greenbelt Act, 2005 to provide that the Greenbelt Plan is deemed to prohibit any person from applying for an aggregate permit to operate a new pit or quarry in the Greenbelt Area or expanding an existing pit or quarry in the Greenbelt Area. A consequential amendment is made to section 9 of the Act.

An Act to amend the Greenbelt Act, 2005 to provide for a prohibition on pits and quarries in the Greenbelt Area and make related amendments

His Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1 Subsection 1 (1) of the Greenbelt Act, 2005 is amended by adding the following definitions:

“pit” has the same meaning as in the Aggregate Resources Act; (“puits d’extraction”)

“quarry” has the same meaning as in the Aggregate Resources Act. (“carrière”)

2 Section 6 of the Act is amended by adding the following subsection:

Prohibition re pits and quarries

(1.1)  The Greenbelt Plan is deemed to prohibit any person from,

  (a)  applying for an aggregate permit to operate a new pit or quarry in the Greenbelt Area; or

  (b)  expanding an existing pit or quarry in the Greenbelt Area.

3 Subsection 9 (1) of the Act is amended by striking out “any of the areas designated as Protected Countryside in the Greenbelt Plan” in the portion before clause (a) and substituting “the Greenbelt Area”.

Commencement

4 This Act comes into force on the day it receives Royal Assent.

Short title

5 The short title of this Act is the No More Pits or Quarries in the Greenbelt Act, 2023.
