EXPLANATORY NOTE

Section 34 of the Ontario Water Resources Act currently governs water taking permits. The Bill adds an exception for the taking of water for constructing, operating, altering, improving or repairing a dam if the dam is associated with the production of electricity and the activity is done in accordance with an approval or in compliance with a Minister’s order under the Lakes and Rivers Improvement Act.

An Act to amend the Ontario Water Resources Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1 Subsection 34 (2) of the Ontario Water Resources Act is amended by adding the following paragraph:

   4.  The taking of water for constructing, operating, altering, improving or repairing a dam within the meaning of the Lakes and Rivers Improvement Act if the dam is associated with the production of electricity and if the activity is done in accordance with an approval granted under that Act or in compliance with an order of the Minister that is made under that Act.

Commencement

2 This Act comes into force on the day it receives Royal Assent.

Short title

3 The short title of this Act is the Ontario Water Resources Amendment Act, 2019.
