An Act to amend the Ticket Speculation Act to prohibit the use of ticket purchasing software and to require the listing of a ticket's original purchase price

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

   1.  The Ticket Speculation Act is amended by adding the following sections:

Prohibition, ticket purchasing software

   2.2  (1)  No person shall purchase a ticket using software that bypasses security measures intended to limit the number of tickets that can be purchased at one time.

Offence

   (2)  A person who contravenes subsection (1) is guilty of an offence and on conviction is liable,

  (a)  if the person is an individual, to a fine of not more than $50,000 or to imprisonment for a term of not more than 12 months or to both; or

  (b)  if the person is a corporation, to a fine of not more than $250,000.

Listing of ticket's original purchase price

   2.3  (1)  A secondary seller who offers a ticket for sale in a print or electronic format shall ensure that the original purchase price of the ticket is listed in the offer.

Offence

   (2)  A person who contravenes subsection (1) is guilty of an offence and on conviction is liable,

  (a)  for a first offence, to a fine of not more than $10,000; or

  (b)  for a second or subsequent offence, to a fine of not more than $25,000.

Commencement

   2.  This Act comes into force on the day it receives Royal Assent.

Short title

   3.  The short title of this Act is the Ticket Speculation Amendment Act (Purchase and Sale Requirements), 2016.

 

EXPLANATORY NOTE

The Bill amends the Ticket Speculation Act to prohibit the use of certain ticket purchasing software and to require secondary sellers to list the original purchase price of a ticket when it is offered for sale in a print or electronic format.
