Government Process Simplification Act

(Ministry of Citizenship, Culture

and Recreation), 1996

EXPLANATORY NOTE

The Bill amends three statutes that are administered by the Ministry of Citizenship, Culture and Recreation. The general purpose of the amendments is to simplify government processes and improve efficiency with respect to three cultural agencies.

McMichael Canadian Art Collection Act

The Act is amended to allow the Board of the McMichael Canadian Art Collection to appoint and remove the Director of the Collection without the Minister's approval.

Ontario Heritage Act

The minimum number of board members of the Ontario Heritage Foundation is reduced from 21 to 12. The amendments also provide that the board members will serve for no remuneration.

Science North Act

The Act is amended to allow the Science North trustees to be reappointed for an unlimited number of terms, to allow the Board to appoint a director and to fix employees' salaries without the Minister's approval and to allow the Board, instead of the Lieutenant Governor in Council, to set the director's remuneration.

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

McMichael Canadian Art Collection Act

1. (1) Subsection 5 (1) of the McMichael Canadian Art Collection Act is amended by striking out "subject to the approval of the Minister" in the first and second lines.

(2) Subsection 5 (2) of the Act is amended by striking out "subject to the approval of the Minister" in the first and second lines.

Ontario Heritage Act

2. Subsection 5 (2) of the Ontario Heritage Act is amended by striking out "twenty-one" in the second and third lines and substituting "12".

3. Section 14 of the Act is repealed and the following substituted:

No remuneration

14. (1) The members of the board of directors of the Foundation shall serve without remuneration but they shall be reimbursed for proper and reasonable travelling and other expenses incurred in the work of the Foundation.

(2) Except as provided by subsection (1), a person who is a member of the board of directors shall not receive, directly or indirectly, any compensation or benefit from the Foundation for any service provided to the Foundation or pursuant to any contract with the Foundation.

Science North Act

4. Subsection 4 (4) of the Science North Act is repealed and the following substituted:

Reappointment

(4) A trustee may be reappointed for one or more further terms.

5. (1) Subsection 6 (1) of the Act is amended by striking out "with the approval of the Minister" in the first and second lines.

(2) Subsection 6 (2) of the Act is amended by striking out "the Lieutenant Governor in Council" in the second and third lines and substituting "the Board".

(3) Subsection 6 (3) of the Act is amended by striking out "with the approval of the Minister" in the first and second lines.

Commencement

6. This Act comes into force on the day it receives Royal Assent.

Short title

7. The short title of this Act is the Government Process Simplification Act (Ministry of Citizenship, Culture and Recreation), 1996.
