An Act to prohibit the construction of certain buildings north of the Legislative Building at Queen's Park

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

Prohibition

   1.  Despite any Act or anything done under any Act, no building or structure shall be constructed if any part of it is visible above the roof of the Legislative Building at Queen's Park in Toronto when viewed by a person standing at the intersection of Queen Street West and University Avenue and facing north.

Decisions or orders, void

   2.  (1)  Any decision or order of the Ontario Municipal Board that would permit construction of a building or structure that would not be in compliance with section 1 is void and of no effect.

Same

   (2)  Subsection (1) applies to any decision or order of the Ontario Municipal Board made after January 1, 2010.

Commencement

   3.  This Act comes into force on the day it receives Royal Assent.

Short title

   4.  The short title of this Act is the Preserving the Dignity of the Ontario Legislative Building Act, 2010.

 

EXPLANATORY NOTE

The Bill prohibits the construction of a building or structure if any part of it is visible above the roof of the Legislative Building in Queen's Park when viewed by a person standing at the intersection of Queen Street West and University Avenue.  The Bill also renders any decision or order of the Ontario Municipal Board that would permit such construction void, including any decision or order made after January 1, 2010.
