An Act respecting

Preamble

The council of the City of Ottawa ("City Council") has applied for special legislation in respect of the matters set out in this Act.

It is appropriate to grant the application.

Therefore, Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

By-laws re taxicabs

1. In a by-law passed to license, regulate and govern owners and drivers of taxicabs used for hire, City Council may define the area or areas of the City to which the by-law applies.

Commencement

2. This Act comes into force on the day it receives Royal Assent.

Short title

3. The short title of this Act is the City of Ottawa Act (Taxicabs), 2001.

The council of the City of Ottawa ("City Council") has applied for special legislation in respect of the matters set out in this Act.

It is appropriate to grant the application.

Therefore, Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

By-laws re taxicabs

1. (1) City Council may pass by-laws to separately license, regulate and govern subclasses of owners and drivers of taxicabs used for hire in the City and Part XVII.1 and paragraph 1 of section 232 of the Municipal Act apply to each subclass.

Powers re: licences

(2) The power to separately license, regulate and govern subclasses of owners and drivers of taxicabs used for hire includes,

(a) the power to define subclasses of owners and drivers of taxicabs used for hire;

(b) the power to permit licensed owners and drivers of a subclass of taxicabs used for hire to provide a taxicab service that falls within a separate subclass on such terms and conditions as City Council considers expedient;

(c) the power to establish criteria for the issuance of new licences, which may include,

(i) entitlement to one licence only,

(ii) the requirement that the licensee be the sole driver of the taxicab,

(iii) consideration of the length of time the applicant has been a taxicab driver in the City,

(iv) the requirement that the applicant has not previously held a taxicab owner's licence; and

(d) the power to establish the method of issuing new licences by means of a lottery system.

Exemption

(3) A by-law passed under subsection (1) may provide that the by-law or any provision of the by-law does not apply to one or more defined areas of the City.

Application to earlier by-laws

2. The powers in this Act may be exercised to amend a by-law that is deemed to be a by-law of City Council by subsection 5 (4) of the City of Ottawa Act, 1999 in respect of the part of the area of the city to which it applies.
